Terms of Service

These Terms of Service ("Terms") govern access to and use of Mentionova, the AI visibility monitoring and content platform available at mentionova.com and app.mentionova.com (the "Service"), provided by Mentionova ("we", "us"). By creating an account or using the Service you agree to these Terms on behalf of yourself and, if applicable, the organization you represent (in which case you confirm you have authority to bind that organization).
1. The Service
The Service monitors how brands appear in AI-generated answers and search, tracks metrics from accounts you connect, and provides content, automation, and reporting tools. We may add, modify, or discontinue features at any time. We will not materially reduce the core functionality of a paid plan during a paid term without notice.
2. Accounts and eligibility
You must be at least 16 years old and provide accurate registration information. You are responsible for your credentials, for all activity under your account, and for ensuring your team members comply with these Terms. Notify us promptly of any unauthorized use.
3. Connected accounts and integrations
You may connect third-party services (such as Google Search Console, Google Analytics, or a CMS). You represent that you have the authority to connect them and grant us the permissions involved. Your use of third-party services is governed by their own terms, and we are not responsible for their availability or behavior. You may disconnect integrations at any time; doing so removes our stored credentials for them.
4. Acceptable use
You agree not to: (a) use the Service for unlawful, deceptive, or infringing purposes; (b) probe, scan, or breach the security of the Service or other users' data; (c) interfere with the Service's operation or impose unreasonable load; (d) reverse-engineer or copy the Service to build a competing product; (e) resell or provide the Service to third parties except as agreed in writing; (f) use the Service to generate or distribute spam, malware, or content that violates others' rights; or (g) misrepresent AI-generated content in ways prohibited by applicable law. We may suspend or limit accounts that violate this section, with notice where practicable.
5. Your content
You retain ownership of the data and content you submit to the Service and of the deliverables generated for your brand ("Customer Content"). You grant us a limited license to host, process, transmit, and display Customer Content solely to provide and improve the Service. You are responsible for having the rights to the content you submit and for its legality.
6. AI-generated output
The Service uses machine-learning models to generate content and insights. Output may be inaccurate, incomplete, or similar to output generated for others. You are responsible for reviewing output for accuracy, legality, and fitness before relying on or publishing it. We make no guarantee that use of the Service will improve rankings, citations, or any other metric.
7. Fees and billing
Paid plans are billed in advance on a monthly or annual cycle and renew automatically until canceled. Usage-based allowances (such as tasks) reset each billing period and do not roll over. Price changes take effect at your next renewal with prior notice. You may cancel at any time; access continues through the end of the paid period. Except where required by law, fees are non-refundable. Late or failed payments may result in suspension after notice. You are responsible for applicable taxes.
8. Trials and beta features
Free trials and features labeled beta or preview are provided "as is", may change or end at any time, and may be subject to additional limits.
9. Intellectual property
The Service, including its software, design, and branding, is owned by us and our licensors and is protected by intellectual-property laws. These Terms grant no rights to our trademarks or to the Service except the limited right to use it in accordance with these Terms. Feedback you provide may be used without restriction or obligation.
10. Confidentiality
Each party will protect the other's non-public information with reasonable care and use it only as needed to perform under these Terms, except where disclosure is required by law.
11. Privacy
Our collection and use of personal information, including Google user data, is described in the Privacy Policy, which is incorporated into these Terms.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DATA FROM THIRD-PARTY SOURCES (INCLUDING AI ENGINES) WILL BE ACCURATE OR COMPLETE.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA. OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THESE LIMITS DO NOT APPLY TO YOUR PAYMENT OBLIGATIONS, EITHER PARTY'S CONFIDENTIALITY BREACHES, OR LIABILITY THAT CANNOT BE LIMITED BY LAW.
14. Indemnification
You will defend and indemnify us against third-party claims arising from Customer Content, your use of the Service in violation of these Terms, or your violation of applicable law.
15. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate the Service or your account for material breach that remains uncured after notice, or immediately for serious violations (such as security abuse). Upon termination, your right to use the Service ends; Sections 5, 9, 10, 12, 13, 14, and 16 survive. You can export your data before deletion; we retain and delete data as described in the Privacy Policy.
16. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, excluding its conflict-of-laws rules. The parties will first attempt to resolve any dispute informally; unresolved disputes will be brought exclusively in the state or federal courts located in Delaware, and each party consents to their jurisdiction. Nothing in this section prevents either party from seeking injunctive relief.
17. Changes to these Terms
We may update these Terms. Material changes will be notified by email or in-app notice at least 14 days before they take effect; continued use after the effective date constitutes acceptance. The "Last updated" date reflects the current version.
